The Ministerial Diploma no. 77/2021, dated 16 August, amended the concentration fees due for procedures before the Competition Regulatory Authority (“ARC”), including notification of concentration’s fee.

Under the terms of the previous law (Ministerial Diploma no. 79/2015), concentration notifications were subject to the payment of a fee corresponding to 5% of the turnover of the year prior to the application.

Now, this rate has been significantly reduced from 5% to 0.11%, with a maximum limit of 2.250.000 MT of the turnover.

This Ministerial Diploma entered into force on 16 August 2021.
